Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Escape Shot mobile application (“App” or “Service”) operated by Meta Experiences S.r.l., a company based in Italy (“we”, “us”, “our” or the “Company”).

Accessing, downloading and using the App are subject to acceptance of and compliance with these Terms. These Terms apply to all users who access, download or use the App.

By downloading, installing or using Escape Shot, the user agrees to be bound by these Terms. If the user does not accept these Terms, in whole or in part, they must not use the App.

1. Scope of the Service

Escape Shot is a mobile application that allows the user to take, import, edit, save and share images and configurations created through the App’s features.

The App is designed to operate primarily locally on the user’s device. Images taken, imported or edited through the App are not sent to Meta Experiences S.r.l. servers for processing, except for any voluntary actions by the user, such as sharing through third-party applications or sending content to the Company for support requests.

2. Acceptance of the Terms

By using the App, the user declares that they have read, understood and accepted these Terms and Conditions.

Use of the App is also subject to our Privacy Policy, which describes how information and permissions related to the use of the App are processed.

3. License to Use

Meta Experiences S.r.l. grants the user a personal, revocable, non-exclusive, non-transferable, non-assignable and limited license to download, install and use the App exclusively for personal use and in accordance with these Terms.

The user does not acquire any ownership rights over the App, the software, the source code, the design, the trademarks, the graphic content or any other element belonging to Meta Experiences S.r.l. or its licensors.

The user agrees not to:

  • copy, modify, adapt or create derivative works from the App;

  • decompile, disassemble, reverse engineer or attempt to extract the App’s source code;

  • remove, alter or obscure any copyright notices, trademarks or other proprietary rights;

  • use the App for unlawful, fraudulent, harmful or unauthorized purposes;

  • distribute, resell, sublicense, rent or transfer the App to third parties;

  • compromise or interfere with the proper functioning of the App.

4. Device Requirements and Permissions

In order to properly use certain features, the App may require access to specific device functions, including, by way of example:

  • camera;

  • photo gallery or photo library;

  • memory or local storage;

  • sharing features available on the device.

The user may manage or revoke such permissions through their device settings. However, revoking certain permissions may limit or prevent the use of specific App features.

5. User Content

The user retains all ownership rights over photos, images, configurations or other content taken, imported, edited, created, saved or shared through Escape Shot (“User Content”).

Meta Experiences S.r.l. does not claim any ownership rights over User Content.

The user is solely responsible for User Content and guarantees that:

  • they have the right to use, edit and share the images stored on their device;

  • they will not use the App to create, edit or share unlawful, offensive, defamatory, violent, discriminatory content, or content that infringes privacy or third-party rights;

  • they will not infringe copyrights, trademarks, image rights, privacy rights or other third-party rights.

6. Local Storage of Content

Escape Shot saves images, configurations and user-generated content primarily locally on the device.

Meta Experiences S.r.l. is not responsible for any loss of data, images or configurations due to:

  • device malfunction;

  • accidental deletion of data;

  • uninstallation of the App;

  • device reset;

  • lack of backup by the user;

  • errors, bugs or incompatibility with the operating system.

The user is responsible for managing, storing and backing up their own content.

7. Sharing of Content

The App may allow the user to share images or configurations through third-party applications, platforms or services, such as social networks, email, messaging apps or other tools available on the device.

Sharing is always voluntarily initiated by the user.

When the user shares content through third-party services, such content will be subject to the terms, conditions and privacy policies of the selected third parties.

Meta Experiences S.r.l. is not responsible for the use, publication, storage, dissemination or processing of User Content by third-party platforms or services.

8. Free Features, Subscriptions and In-App Purchases

Escape Shot may offer free features, in-app purchases and/or an optional subscription model.

The App may be used free of charge with certain features available without payment. Any in-app purchases or subscriptions may be used, for example, to remove the watermark from saved or shared images, or to access other premium features that may be available within the App.

Features, prices, subscription duration and economic conditions are displayed within the App before purchase.

9. Payments

All payments relating to in-app purchases or subscriptions are handled exclusively through the official distribution platforms:

  • Google Play Billing, for Android devices;

  • Apple App Store / In-App Purchase, for iOS devices.

Meta Experiences S.r.l. does not collect, store or have direct access to the user’s complete payment details, such as credit card numbers, bank details or payment credentials.

Google and Apple directly manage payment processing according to their respective terms of service, privacy policies and commercial policies.

For subscriptions, Google Play and Apple provide developers with tools and information regarding the subscription status, such as renewals, expirations or cancellations, which are necessary to manage access to purchased features.

10. Renewal, Cancellation and Subscription Management

Subscriptions, where available, may renew automatically according to the conditions shown to the user at the time of purchase.

The user is responsible for managing their subscription through the account of the platform used for the purchase:

  • Google Play account, for purchases made on Android devices;

  • Apple ID / App Store account, for purchases made on iOS devices.

Subscription cancellation must be carried out through the Google Play or Apple App Store account settings. Uninstalling the App does not necessarily automatically cancel the subscription.

On Google Play and Apple App Store, subscription cancellation normally takes effect at the end of the current billing period, unless otherwise provided by the applicable platform policies or local laws.

11. Refunds

Refund requests relating to in-app purchases or subscriptions are handled according to the policies of the platform through which the purchase was made:

  • Google Play, for purchases made on Android;

  • Apple App Store, for purchases made on iOS.

Meta Experiences S.r.l. cannot guarantee approval of refund requests, as such requests are subject to the rules, procedures and decisions of the payment platform used.

12. Availability of the App

The App is provided “as is” and “as available”.

Meta Experiences S.r.l. undertakes to offer a functioning and updated service, but does not guarantee that the App will always be available, error-free, compatible with all devices or operating systems, or that it will operate without interruptions.

The availability of the App may depend on external factors, including operating system updates, device limitations, third-party services, digital stores, Internet connection or other elements not directly controlled by Meta Experiences S.r.l.

13. Changes, Suspension or Discontinuation of the Service

Meta Experiences S.r.l. reserves the right to modify, update, suspend, withdraw or discontinue, temporarily or permanently, the App or some of its features, at any time and without prior notice, where permitted by applicable law.

We shall not be liable if, for any reason, the App or part of its features are unavailable at any time or for any period.

14. App Updates

Meta Experiences S.r.l. may release updates, fixes, improvements or new versions of the App.

Some updates may be necessary in order to continue using the App or some of its features properly.

The user is responsible for installing updates available through the Google Play Store or Apple App Store.

15. Third-Party Services

The App may interact with or use third-party services, including Google Play Services, Google Play Billing, Apple App Store, Apple In-App Purchase, sharing services, social networks, messaging apps or other tools available on the user’s device.

The use of such services is subject to the terms and privacy policies of the respective third parties.

Meta Experiences S.r.l. is not responsible for the operation, content, policies, decisions or data processing carried out by third-party services.

16. Prohibited Use

The user agrees not to use the App:

  • in violation of laws, regulations or third-party rights;

  • to create, edit or share unlawful, defamatory, offensive, violent, discriminatory content, or content that infringes the privacy of others;

  • to infringe copyrights, trademarks, image rights or other intellectual property rights;

  • to attempt to gain unauthorized access to systems, devices, accounts or data;

  • to interfere with the security, integrity or operation of the App;

  • for commercial purposes not authorized by Meta Experiences S.r.l.

17. Intellectual Property

The App, software, code, structure, design, interfaces, trademarks, logos, graphic elements and any other material belonging to Escape Shot or Meta Experiences S.r.l. are protected by intellectual property laws.

Except as expressly provided in these Terms, no rights are transferred to the user.

The user may not use trademarks, logos, trade names or other distinctive signs of Meta Experiences S.r.l. without prior written authorization.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Meta Experiences S.r.l. shall not be liable for indirect, incidental, special, consequential or punitive damages, including, by way of example, loss of profits, loss of data, loss of content, loss of business opportunities, business interruption, reputational damage or other intangible losses arising from:

  • use of or inability to use the App;

  • errors, bugs, malfunctions or incompatibility of the App;

  • loss of images, configurations or other locally saved content;

  • improper use of the App by the user;

  • actions, omissions or services of third parties;

  • changes, suspension or discontinuation of the App.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

19. Indemnification

The user agrees to indemnify and hold harmless Meta Experiences S.r.l., its directors, employees, collaborators and partners from any claim, damage, liability, cost or expense arising from:

  • the user’s use of the App;

  • violation of these Terms;

  • violation of third-party rights;

  • content created, edited, saved or shared by the user through the App;

  • unlawful or unauthorized use of the App.

20. Privacy

Use of the App is also governed by our Privacy Policy, which describes how information and permissions related to the App are processed.

The user is invited to carefully read the Privacy Policy before using Escape Shot.

21. Minors

Escape Shot is not intended for individuals under the age of 13.

The user declares that they are at least 13 years old or, where required by applicable law, that they use the App with the consent and supervision of a parent or legal guardian.

22. Governing Law

These Terms are governed by and interpreted in accordance with Italian law, without regard to conflict of law provisions.

23. Jurisdiction

For any dispute relating to the interpretation, execution or validity of these Terms, the competent court shall be the court provided for by applicable law.

If the user acts as a consumer, the mandatory rights and competent jurisdiction provided by applicable consumer protection laws shall remain unaffected.

24. Changes to the Terms

Meta Experiences S.r.l. reserves the right to update, modify or replace these Terms at any time.

Any changes will be published within the App, on the website or in another dedicated section.

Users are advised to review these Terms periodically to check for any updates.

Continued use of the App after the publication of changes constitutes acceptance of the updated Terms.
